Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a dust explosion, deflagration and/or other fire hazards from non conductive piping being utilized to transport combustible dust. a) Bottom Shed- The employer did not ensure that a conductive metallic piping was utilized to transport combustible wood dust. PVC piping approximately 12 inches in diameter and approximately 15-20 feet long was utilized in the saw mill to transport dust from the GBN line to the dust collector. Employees were exposed to fire/explosion hazards while performing various assigned operator duties involving saw mill operations. A sample taken on November 02, 2011 was determined to be a CLASS II combustible dust. Among other methods, one feasible and acceptable method to correct the hazard is to install metallic conductive piping from the GBN line and notcher to its final destination in the dust collector as required by NFPA 664," Standard for the Prevention of Fires and Explosions in the Wood Processing and Wood Working Facilities." 2007 Edition: Chapter 8, Section 8.2.2.2.1.2.
