Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards. a) 439 E. Lincoln Highway, Exton - An employee was directed to work approximately 35 feet above ground level from a job-made platform that was sitting on the forks of a Lull, Skyjack VR-1056D (Variable Reach Telehandler). 1) The platform was not approved by the manufacturer. 2) No fall protection was provided for the employee at 35' from ground level. One feasible and acceptable method to correct this hazard, among other means, is to follow the guidance set forth in the Lull, Skyjack VR-1056D Operator and Safety Manual, which prohibits the use of the telehandler as a man lift or equip the telehandler with a personnel work platform.
