NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each of its employees, employment and a place of employment which was free from recognized hazards that are causing or were likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public employment have been recognized: a) Palatine Tn Hwy Dept - The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. On December 13, 2011, employees working on Oswegatchie Road were not wearing a high visibility garments to make themselves more visible to passing motorists or operators of worksite equipment. Note: A reasonable and adequate method to correct the hazard includes, but is not limited to, the employer ensuring that all employees working in areas where they may be exposed to vehicular traffic or moving equipment wear high visibility garments that meet ANSI requirements.
