Text For Citation: 01 Item/Group: 002 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection, and falling hazards: a.On or about November 9, 2011, the employer did not ensure that on the Mack yard truck that had no driver side door that the manufacturers installed safety restraint device seat belt was in a usable condition and used by the employees per Mack truck manufacturers operation manual, exposing the operator to being ejected from the truck and falling to the ground. Feasible and acceptable methods to correct the hazard include, but are not limited to the following: Obtain and install approved manufacturers safety restraint device seat belt and driver side door for the Mack model 89R yard truck. ABATEMENT CERTIFICATION AND DOCUMENTATION ARE REQUIRED.
