Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a.)East Crystal Lake Avenue Site - The crane operator had not taken a written examinations on the operational characteristics of a Tadano crane, its controls and emergency control skills,on or about February 7, 2011. b.)East Crystal Lake Avenue Site - The crane operator had not demonstrated the ability to read, write, comprehend and use arithmetic and a load chart for a Tadano crane, on or about February 7, 2011. c.)East Crystal Lake Avenue Site - The crane operator did not complete a written and verbal combination examination on load/capacity chart usage that covered a selection of configurations for the Tadano crane, on or about February 7, 2011. d.)East Crystal Lake Avenue Site - The crane operator did not demonstrate an understanding of the applicable sections of ASME B30.5 and OSHA 1910.180, on or about February 7, 2011. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that all crane operators meet the qualifications contained in ASME B30.5-2007, section 5-3.1.2, which provides the qualifications all crane operators must meet.
