North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by chain saw hazards: a)arboricultural site, 247 Presbyterian Road, Mooresville, NC, employees operated chainsaws above chest height and overhead to reach and cut suckers and tree limbs while standing backwards on a 10-foot step-ladder. Among other methods, one feasible and acceptable abatement method to correct this hazard is for the chain-saw operator to position himself facing the ladder so that he is certain of footing before starting to cut and to always position himself so that he is above the cut. REFERENCE: AMERICAN NATIONAL STANDARD INSTITUTE (ANSI) Z133.1- 2006, Safety Requirements for Arboricultural Operations, Chain Saws, 6.3.12: The chain-saw operator shall be certain of footing before starting to cut. The chain saw shall not be used in a position or at a distance that could cause the operator to become off-balance, have insecure footing or relinquish a firm grip on the saw."
