Nevada Revised Statute 618.375(1): Every employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: The employer did not ensure that the Mustang skid steer #2040, was properly maintained, as follows: a) At Re-New Recycling, an employee was operating a Mustang #2040 skid steer with a Versatech grapple bucket. The employer had purchased the skid steer on May 2, 2010 at Ritchie Bros. Auctioneers. The engine hour meter read 1488. At the accident scene, there was significant evidence of hydraulic oil under the skid steer. On November 19, 2010, when mechanical testing was completed, there was significant evidence of hydraulic oil leakage on the ground, on the hoses and on the skid steer. An oil dipstick was missing, therefore employees were not able to measure the oil level. No preventative maintenance was conducted as required by the manufacturer's operator's hand book. No preventative maintenance records were maintained by the employer. The employer and several employees stated that they only added hydraulic oil and fluid when needed. Reference: Mustang #2040 skid steer loader Operator's Handbook, edition 1/1997: Page 21: Daily Inspection: The Mustang Skid Steer Loader must be in good operating conditions. Check the following items: Engine Oil, Hydraulic/Hydrostatic Fluid, Engine Cooling System, Operator cab, seat belt and pedal interlocks, lift and cylinder pivot pins, tires and tire pressure, any loose of broken parts, safety tread and safety signs. Follow the maintenance requirements on the lubrication chart, page 51. Page 36: Service Schedule: Maintenance work must be done at regular intervals. Failure to do so will result in excessive wear and early failures. Page 50: Maintenance chart. The Loader Hydraulic system and the engine crank case was to be checked every 10 hourly intervals maximum. A feasible means of abatement would be to follow the Mustang Skid Steer Loader Operating Handbook for preventative maintenance requirements and develop preventative maintenance records to ensure timely service is achieved.ce
