Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by or crushed by hazards: On or about February 22, 2010, and times prior thereto, at 5755 Highway 61 South in Wilson, Arkansas, southeast corner of the plant, a current inspection by a licensed authority had not been performed on the 1959 #1487 Freight Elevator that was being used by employees to transport materials between the 1st and 2nd floor levels. Employer allowed employees to use the elevator with an expired Elevator Permit dated 11/2007. Employees were exposed to fall, struck by or crushed by hazards. Feasible and acceptable methods to correct this hazard is: (A)Ensure the elevator is inspected, tested by a licensed authority and is maintained in accordance with ASME A.17.1 Safety Code for Elevators and Escalators. (B)Incorporate specific training procedures relevant to elevator safety into your current documented safety and training program.
