Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recogn ized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to the hazards of falling from elevat ion: The employer does not provide a safe means of access and egress to the top of the oven. a)Plant #1, Oven 1: On or about January 8, 2011, and times prior th ereto on oven 1 where employee(s) were exposed to falls from a height of 6' 3" t o the concrete floor below, while accessing and descending from a 6' Werner fibe rglass ladder to/from the top of the oven. b)Plant #1, Oven 2: On or about January 8, 2011, and times prior thereto on oven 2 where employee(s) were exposed to falls from a height of 6' 3" to the concret e floor below, while accessing and descending from a 6' Werner fiberglass ladder to/from the top of the oven. c)Plant #1, Oven 3: On or about January 8, 2011, a nd times prior thereto on oven 3 where employee(s) were exposed to falls from a height of 6' 3" to the concrete floor below, while accessing and descending from a 6' Werner fiberglass ladder to/from the top of the oven. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE ABATEMENT METHODS TO CORRECT THIS HAZARD ARE TO: 1) USE THE SINGLE ENTRY MOBILE STAIRS TO GAIN ACCESS TO THE TOP OF THE OVEN. 2) AN ALT ERNATIVE COULD BE TO USE THE WERNER SELF SUPPORTING LADDER BY TYING IT OFF TO TH E STRUCTURE TO PREVENT SIDEWAYS MOTION AS PER ANSI A14.5-2007 WHICH IS ATTACHED. Pursuant to 29 CFR 1903.19, within ten (10) calendar days, the employer must sub mit an abatement plan describing the actions it is taking to ensure safe access to the top of oven 1, oven 2, and oven 3.
