Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or crushed-by hazards: a) This violation was discovered on or about April 07, 2011, in building (76) shipping department, where employee(s) were exposed to struck-by and/or crushed-by hazards while working from Perry prefabricated mobile interior scaffolds that were being moved by other employees; and b) This violation was discovered on or about May 26, 2011, in building (198) receiving department, where employee(s) were exposed to struck-by and/or crushed-by hazards while working from Perry prefabricated mobile interior scaffolds that were being moved by other employees. Among other methods, one feasible and acceptable means of abatement includes, but is not limited to: following the guidance in the manufacture's manual titled, Instructions for the Assembly and SAFE USE of Perry Scaffolds and Scaffold Towers (ELITE AND CLASSIC SERIES ONLY). On page 4 under the title of Safe Use it states, "Never roll a Perry Scaffold while a person is standing on the platform". In addition, on page 8 under the section titled, Assembly of a Perry Scaffold Tower it states, "Do Not Roll A Perry Scaffold Tower When A Person Is On the Platform". Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit an abatement plan describing the action it is taking to establish, communicate and implement written procedures to ensure that Perry Scaffolds are not rolled or moved while an employee is standing on the working platform.
