Text For Citation: 01 Item/Group: 002 Hazard: DUST&FUMES

North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards due to the lack of dust control: a)production area, the screen tent enclosures installed on storage hoppers, weighing hoppers and blend tanks were not dusttight or equipped with continuous suction to control the escape of fugitive dust during normal operation. b)production area, near the roll-up door entering the packaging/laminating area, pneumatic transport ducting was not maintained in such a manner to minimize the escape of fugitive dust during normal operation. On 12/14/09, 12/16/09, 12/18/09, and 3/12/10, a number of leaks were observed at different points along the transport duct line contributing to a build-up of combustible dust in the area. Feasible and acceptable methods to correct these hazards is to install dust controls in accordance with National Fire Protection Association (NFPA) 654, Standard for the Prevention of fire and dust Explosions from the Manufacturing, Processing, and Handling of Combustible Dust Particulate Solids (2006), paragraphs 8.1.1, 7.17.1, 7.2.3.2.2, and 8.2.1.1.
