NYSLL Article 2, Section 27-a.3.a(1): The employer did not furnish to each of its employees, employment and a place of employment which was free from recognized hazards that are causing or were likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety or health of its employees. In applying this paragraph, fundamental distinctions between private and public employment have been recognized. NOTE: The employees were exposed to the hazards of serious injury or death from falls when using Alternating Tread Stairs that were not installed according to the OGS specifications. Feasible abatement methods could include installing stairs at the proper angle, as specitied in OGS drawing number 1 PH-102 sheet 2 ground level plan. a) NYSDOCCS Great Meadow Corr. Fac. - The upper Alternating Tread Stairs in the temporary tower was not installed in accordance with OGS project number M2848-c. The stairway was installed at a 75 degree angle. b) NYSDOCCS Great Meadow Corr. Fac. - The lower Alternating Tread Stairs in the temporary tower were not installed in accordance with OGS specifications. The stairway was installed at a 60 degree angle.
