North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or caught in between hazards: a)Shop Area - the "SCAG" Turf Tiger zero turn riding mower, model #STT61A-27CH, serial #938 1624 equipped with a stowable roll over protection bar (ROPS) was not equipped with a seatbelt. Abatement note: One means of abatement would be to purchase and install a new seatbelt equipment on all equipment with roll over protection (ROPS) devices according to the manufacturer's requirements. Reference: "SCAG" power equipment model STT operators manual, section 2, page 6 - "Operating Instructions - 1. Securely fasten seat belt during operation of the machine." Warning label on tractor ROPS bar - "Always use the seatbelt when the ROPS is locked in the upright position."
