North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to frequent fires caused by no testing, inspection or routine maintenance on the exhaust system, ( duct, duct intake, hood, enclosure, or canopy). a)facility, SP-1,2,and 3 - exhaust system was not tested, and no routine maintenance was performed to ensure safe operating conditions of the exhaust system. b)facility, SP-1,2,and 3 - exhaust system components, (duct and duct intake. hood, enclosure, or canopy) were not inspected monthly. c)facility, SP-1,2,and 3 - exhaust system was not tested annually to demonstrate continued performance. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to test, inspect, and to perform routine maintenance on exhaust system for a safe operating condition.
