North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by hazards due to possible hoist failure resulting from lack of proper inspection and testing of the electric hoist: a)facility, yard, boat hoist - the electric powered hoist was not provided with an inspection prior to the initial use. b)facility, yard, boat hoist - the electric powered hoist was not provided with an operational test. c)facility, yard, boat hoist - the electric powered hoist was not provided with a load test. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to inspect and test the hoist in accordance with ASME B30.16-2007, sections 16- 2.1.1(a) Initial Inspection, 16-2.2.1 Operational Testing, and 16-2.2.2 Load Testing.
