Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm: Lawn Care Work: On or about June 25, 2010, employer did not provide training in the operating instructions, warnings, or precautions listed in the manufacturer's operator's manual related to seat belt use, when operating a Kubota L4200 tractor on an embankment at the depth of 10 feet, exposing employee to hazards of being ejected from cab, struck by, and rollover.
