Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm from falls from heights, struck-by, and caught in between: At the worksite: On or about December 26, 2009, and at times prior thereto, the employer allowed an employee to remain in the derrick during an instance of unusual loading while making a hard pull resulting in the structural failure of the derrick. Employees were exposed to the hazards associated with falls from heights, struck-by, and caught in between. Among others, one feasible and acceptable method of abatement would be to comply with American Petroleum Institute (API) Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations.
