Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)By the Lathe Electro Cycle, a Ton Budgit hoist was installed on an "I" beam of the building structure without being designed to withstand the loads and forces imposed by the hoist for the rated load, this exposed employees to struck by hazards. Among other methods, feasible and acceptable means to correct these hazards are to use a safer alternate method such as ensure the supporting structure was designed to withstand the loads and forces imposed by the hoist for the rated load as outlined in An American National Standard ASME B30.16-2003 Overhead Hoists (Underhung), Section 16-1.3.2 Support. Certification, with date and method of abatement required. Certification of abatement is required by 29 CFR Part 1903 and is to be submitted within ten (10) calendar days after the abatement date.ment
