Nevada Revised Statute 618.375(1): Duties of employers. The employer failed to furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees: The employer did not ensure that proper brake maintenance was maintained, as follows: a) At the McCarran International Airport Utilidor, an employee was operating a New Holland SkidSteer Model Lx565, #284986. The employer had purchased the skidsteer on August 30, 2001, from APCO Equipment. Brake maintenance had not been conducted every 100 hours as required by the manufacturer. Preventative Maintenance records provided by the employer did not indicate that parking brake maintenance had been conducted since August 30, 2001. When the braking system was tested by a third party on March 12, 2009, it was determined that the parking brake system had failed. Reference: New Holland Operator's Manual Lx565 9/96 edition: 1. Page 1-7, paragraph 1: "The brake is used to lock the wheels to prevent movement while the unit is stationary or as an emergency brake in case primary hydrostatic braking should fail." 2. Page 4-4; Maintenance Interval Chart: Check parking brake adjustment every 100 hours. A feasible means of abatement would be to follow the New Holland Operator's Manual for maintenance.
