Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall, struck-by and crushed-by hazards: At the facility, on or about March 18, 2009 when a Caterpillar 90 powered industrial truck was used to lift an employee on a work platform that was not attached to the powered industrial truck. This condition exposed employees to the hazard of falls from elevation and being struck by the platform.
