Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards associated with damaged storage racks: On or about 01/20/09 at Clarkesville, GA: Employees were exposed to struck by hazards, while performing work around damaged storage racks. The employer failed to regularly inspect rack systems for damage and replace or repair damaged racks. The following racks were identified as damaged: a).Main Shipping and Receiving Warehouse: Rack 2016Bent column, left end Rack 2020Bent column right end Rack 5502Bent leg & cross brace Rack 5706Bent columns & cross beams b).R & D Storage Area: Row 014BCross & lateral brace damage Row 027Bottom lateral bracket detached Row 040-ABottom brace detached Row 067-ASide bracket detached Row 094-BBottom cross brace detached Row 100-BBottom cross brace detached Row 1017Bottom cross brace detached Row 48-BBottom cross brace detached AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THESE HAZARDS IS: 1. The employer shall follow American National Standard Institute (ANSI) MH16.1:2008, Specification for the Design, Testing, and Utilization of Industrial Storage Racks, Section 1.4.1(2), which states, "The owner shall maintain the structural integrity of the installed rack system by assuring proper operational housekeeping and maintenance procedures including, but not limited to the following: 2. Regularly inspect for damage. If damage is found, immediately unload the affected area and replace or repair any damaged columns, beams, or other structural components. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
