Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a hazard of falling to a lower level: (a)Metals - An employee stood on the top step of a 6-foot Louisville fiber glass step ladder, model FS1506, to work, and the ladder manufacturer's label indicated the highest standing level at 3 feet 9 inches (one step down from the top step), on or about February 18, 2010. Among other methods, one feasible and acceptable abatement method to correct this hazard includes using a ladder of sufficient height which does not require an employee to step or stand higher than the step or rung indicated on the manufacturer's label marking the highest standing level of the ladder and which does not require an employee to step or stand on the top step of a step ladder as specified in the American National Standard for Ladders - Portable Reinforced Plastic - Safety Requirements (ANSI A14.5-2000), Section 9.3.2 Climbing and Working Locations.
