North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Crushed by unsecured vehicles [ Ref ANSI/ALI ALOIM -1994.4.5 If there are any conditions reported as described in 4.4.4 (4-10) (6) excessive wear of components, the lift shall not be used until the appropriate repairs have been made by a qualified automotive lift personnel. In order to ensure the lift id not used until repairs are made the lift shall be locked or tagged out ] a)Bay #4,6 - the Magnum lifts were reported to management as having a worn shim that allowed the vehicles to be lifted "out of square" and the lifts were to remain in service until their replacement Abatement note: One means of abatement would be to establish a "tag system " to be applied at the power control switch and on the lift controls informing employees that the lift is "Out of Service" with only management having the authority to have the tags removed after the repairs are confirmed.
