Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards from elevated working surfaces. For the employee working in the rod basket, on or about August 12th, 2008. The employer did not ensure employees working in the rod basket were using appropriate fall protection. OR, IN THE ALTERNATIVE: 29 CFR 1910.23(c): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivelent). One feasible means of abatement is to ensure employees use personal fall protection any time they are working on elevated working surfaces.
