Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards in that the Kelly hose did not have a whip check connected to prevent the hose from striking employees if it came loose: (a) For the employees working on the rig floor during drilling operations on Cyclone Rig #20, located at 5202 Highway 8, Stanley, North Dakota. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure that whip checks are attached to high pressure hoses as described in Section 9 of the American Petroleum Institute - Recommended Practice 54, Recommended Practice for Occupational Safety for Oil and Gas Well Drilling and Servicing Operations, section 9.13.3, which states, "Flexible high pressure hoses should be properly secured to prevent unsafe movement."
