Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to structural collapse of the rig: a) On or about February 12, 2009, the employer did not ensure that employees were protected from crushing and struck-by hazards while working with and near #5 rig. Proper inspections and preventative maintenance were not being performed on the rig super-structure. The super-structure had bent and twisted uprights, struts, beams, and braces. One feasible and acceptable abatement method among others is to develop and implement procedures for inspections, maintenance, and repair of rig super-structures that conforms to the American Petroleum Institute Recommended Practices (API-RP 4G) Third Edition, April 2004.
