Text For Citation: 01 Item/Group: 002 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to amputation injuries: a) On or about January 14, 2009 and times prior, employees were exposed to amputations from being struck by the rail stringer. Adequate procedures were not developed and implemented to warn and remove employees from the rail tie down car as the rail stringer approached and traversed across the rail car. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to develop and implement procedures that account for all employees on the rail cars and to warn and remove employees from the car when the rail stringer is advanced.
