Section 5(a)(1) of the Occupational Safety and Health Act of 1970; The employer did not furnish employment and a place of employment, which was free from recognized hazards which were likely to cause death or serious physical harm to employees, in that, employees were exposed to entrapment/hypothermia hazards: a. On or about January 6, 2009, and at times prior, the employer did not ensure the emergency egress handle on the inner side of the walk-in refrigerator beer storage cellar door was operational. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to repair the handle to ensure employees could exit the refrigerated beer cellar if the door were to close behind them.
