Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 11/29/07 at the Red Building; a powered industrial truck weighing approximately six thousand nine hundred and fifty pounds was loaded onto the freight elevator with a capacity of four thousand pounds exceeding the capacity. One feasible and acceptable abatement methods to correct this condition would be; conspicuously position and permanently secure to the inside of the car enclosure signs indicating the prohibition of overloading the freight elevator, train Arctic Glacier employees and contractors on the capacity of the freight elevator and the probation of overloading freight elevator.
