Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to fire and explosion hazards due to the generation of explosive alfalfa dust during cleaning operations in the Hay Room: a.Vitakraft Sunseed, Inc. located in Weston, Ohio: On or about August 6, 2008, the employer did not ensure employees, working in the Hay Room, using compressed air to remove alfalfa dust from room surfaces, ensured that precautions were taken to eliminate ignition sources. The alfalfa dust captured by the dust collector had a kst value of 7.48 bm/s and is classified as an explosive dust. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to ensure employees minimize the generation of dust in accordance with National Fire Protection Agency (NFPA) 61 "Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities" (2008). In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.t,
