Section 50-9-5.A, NMSA 1978 (New Mexico Occupational Health and Safety Act): Every employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees: On December 11, 2007 employees were exposed to concentrations of carbon monoxide in excess of 200 ppm for at least 5 continuous minutes during afternoon shifts in the warehouse at Pepsi Bottling Group. The National Institute for Occupational Safety and Health (NIOSH) recommends carbon monoxide exposure not exceed a 5 minute ceiling limit of 200 ppm due to potential cardiovascular system effects. Cincinnati, OH: U.S. Department of Health and Human Services, Public Health Service, Centers for Disease Control, National Institute for Occupational Safety and Health. DHHS (NIOSH) Publication No. 92-100. Feasible means of abatement would include regular scheduled maintenance of forklifts by experienced mechanics to ensure carbon monoxide emissions are kept as low as feasible and within safe operating limits.
