Text For Citation: 01 Item/Group: 002 Hazard: FALLING
Title 40.1-51.1(a) Code of Virginia: The employer, National Amusements, Inc. did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious bodily harm to employees. On December 10, 2008, at the Mount Vernon Multiplex, located at 7940 Richmond Highway, Alexandria, Virginia, employees of National Amusements used a 12' Louisville step ladder to gain access to the 12' 9" high speaker platform located behind the movie screen in theater #10. While the ladder was in use by employees, it was closed and leaning against the wall, exposing the employees to fall hazards. One feasible and acceptable abatement method, among others, to correct this hazard is for the employer to use the ladder in accordance with American National Standards Institute (ANSI) A14.2-1990, Portable Ladder Safety Requirements, Section 8.3.13.2 which provides as follows: "The user shall ensure that the stepladder is fully opened, with spreaders locked and all feet contacting firm level support surface."
