Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that: employees were using damaged, broken or in need of repair stabilizing jacks. (a)Loading Docks - On or about 7/7/2009 employees were observed using damaged, broken or in need of repair stabilizing jacks. Abatement Note: "Among others, one feasible and acceptable method of abating this violation is to set a policy whereby stabilizing jacks are inspected daily and taken out of service if need be until repairs are made."
