Text For Citation: 01 Item/Group: 002 Hazard: FALLING
Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: ANSI/SIA A92.9-1993, Paragraph 6.8: The owner did not train his maintenance personnel in inspection and maintenance of the Mast Climbing Work Platform in accordance with sections 6.3, 6.4, 6.5, 6.6 and 6.7 of this Standard and with the manufacturer's recommendations. ANSI/SIA A92.9 -1993, Parrafo 6.8: El dueno no adiestro a su personal de mantenimiento en la inspeccion y el mantenimiento de la Plataforma de Trabajo de acuerdo con las secciones 6.3, 6.4, 6.5, 6.6 y 6.7 de este reglamento y con las recomendaciones del fabricante. Reference 10 OSH 1926.16(c): To the extent that a subcontractor of any tier agreed to perform any part of the contract, he also assumed responsibility for complying with the standards in this part with respect to that part. Thus, the prime contractor assumed the entire responsibility under the contract and the subcontractor assumed responsability with respect to his portion of the work. Reference: Multi-employer Intaco Equipment Rentals Corp., was the owner of the Mast Scaffold and the employer of the mechanic that performed repairs and maintenance to the scaffold the day of the accident. Intaco Equipment Rentals Corp., rented the scaffold to Desarrollos Metropolitanos and at the same time Desarrollos Metropolitanos provided the scaffold to Marino Construction employees. The Marino Construction employees were using the scaffold to be able to reach the 18th floor of the building for plastering task. The mechanic did not follow the manufacturers instructions and the ANSI/SIA A92.9-1993 for reparing and mantaining the scaffold and as a result, two employees of Marino Constructions died when the mechanic was repairing the scaffold while employess of Marino Construction were on the scaffold working on the 18th floor when the scaffold fell to ground with the employees inside the scaffold. The mechanic informed Marino Construction employees to get out of the scaffold before beninning to fix the scaffold. At the Atlantis Construction Proyect at the facade located in the back side of the building. There was a mast scaffold used by employees for reaching the 18th floor were they were plastering exterior walls. The scaffold platform was at approximately 150 feet of height when another employee went to provide maintenance to the scaffold. The maintenance work consisted in changing one of the wheels that maintained elevated the platform. Meanwhile the plasterers kept working while the mechanic was repairing the scaffold. The scaffold Trademark was Hek, model MS Pro Max. It was a rainy day withstrong winds when the mechanic took off the wheel to replace it with a new one. At this moment the scaffold platform came down in a free fall and the plasterers inside the platform died. PROSHA recommendes Intaco Equipment Rental Corp., to retrain an requalify the mechanic due to the severity of the errors committed. Hazard: Scaffold failure, breaks or fell while employees were using it. Referencia 10 OSH 1926.16(c): Hasta el punto en el que un contratista de cualquier nivel estuviese de acuerdo en realizar cualquier parte del contrato, el tambien asumio responsabilidad con el cumplimiento de los reglamentos de esta parte en lo que respectaba su parte del trabajo. Por lo que, el contratista general asumio la responsabilidad total bajo el contrato y el subcontratista asumio la responsabilidad en lo que respectaba a su porcion de trabajo. Referencia: Multi - Patronos Intaco Equipment Rentals Corp., era el dueno del Andamio de Mastil y era el patrono del mecanico que realizo trabajos de reparacion y mantenimiento al andamio el dia del accidente. Intaco Equipment Rentals Corp., le alquilo el andamio a Desarrollos Metropolitanos y a su vez Desarrollos Metropolitanos le proveyo el andamio a Marino Construction. Los empleados de Marino Construction estaban usando el andamio para poder alcanzar el piso 18 en donde se encontraban empanetando paredes. Como resultado de que el mecanico de Intaco Equipment Rentals Corp., no siguio las instrucciones del manufacturero ni el ANSI/SIA A 92.9-1993, para realizar la reparacion y el mantenimiento del andamio, dos empleados de Marino Construction murieron cuando el mecanico reparo el andamio mientras los empleados de Marino Construction se encontraban trepandos en el piso 18 y el andamio se vino abajo con los empleados que se encontraban trabajando desde el andamio. El mecanico le informo a los empleados de Marino Construction que se tenian que salir del andamio antes de comenzar a arreglarlo. En el Proyecto de construccion Atlantis, en la parte posterior del edificio habia un andamio de mastil que era usado por albaniles para poder alcanzar la pared exterior del piso 18 donde los albaniles se encontraban empanetando. La plataforma del andamio de mastil se encontraban a una altura aproximada de 150 pies cuando otro empleado fue a realizar trabajos de mantenimiento al andamio. El trabajo de mantenimiento consistia en cambiar una de las ruedas que mantenia la plataforma elevada. Los albaniles se mantuvieron trabajando mientras el mecanico estaba reparando el andamio. El andamio era marca Hek, Modelo MS Pro Max. El dia estaba lluvioso con vientos fuertes al momento que el mecanico saco la rueda para remplazarla por una nueva. En ese momento el andamio cayo en caida libre y los albaniles en la plataforma murieron. PROSHA recomendo readiestrar y recualificar al mecanico debido a la severidad de los errores cometidos. Riesgo: Andamio falle, se rompa o caiga mientras los empleados lo estubiesen usando.sen
