Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: ANSI/SIA A92.9-1993, Paragraph 7.6: The user did not train his maintenance personnel in inspection, erection and maintenance of the Mast Climbing Work Platform in accordance with sections 7.2, 7.3, 7.4 and 7.5 of this Standard and with the manufacturer's recommendations. ANSI/SIA A92.9 -1993, Parrafo 7.6: El usuario no adiestro a su personal de mantenimiento en la inspeccion, levantamiento y el mantenimiento de la Plataforma de Trabajo de acuerdo con las secciones 7,2, 7,3, 7,4 y 7,5 de este reglamento y con las recomendaciones del fabricante. At the Atlantis Construction Proyect at the facade located in the back side of the building. There was a mast scaffold used by employees for reaching the 18th floor were they were plastering exterior walls. The scaffold platform was at approximately 150 feet of height when another employee went to provide maintenance to the scaffold. The maintenance work consisted in changing one of the wheels that maintained elevated the platform. Meanwhile the plasterers kept working while the mechanic was repairing the scaffold. The scaffold Trademark was Hek, model MS Pro Max. It was a rainy day with strong winds when the mechanic took off the wheel to replace it with a new one. At this moment the scaffold platform came down in a free fall and the plasterers inside the platform died. The employer did not provide training to their maintenance personnel and maintenance procedures recommended by ANSI/SIA A92.9-1993 paragraphs: 7.2, 7.3, 7.4, 7.5, 7.6 and the manufacturer's manual. Hazard: Scaffold failure, breaks or fell while employees were using it. En el Proyecto de construccion Atlantis, en la parte posterior del edificio habia un andamio de mastil que era usado por albaniles para poder alcanzar la pared exterior del piso 18 donde los albaniles se encontraban empanetando. La plataforma del andamio de mastil se encontraban a una altura aproximada de 150 pies cuando otro empleado fue a realizar trabajos de mantenimiento al andamio. El trabajo de mantenimiento consistia en cambiar una de las ruedas que mantenia la plataforma elevada. Los albaniles se mantuvieron trabajando mientras el mecanico estaba reparando el andamio. El andamio era marca Hek, Modelo MS Pro Max. El dia estaba lluvioso con vientos fuertes al momento que el mecanico saco la rueda para remplazarla por una nueva. En ese momento el andamio cayo en caida libre y los albaniles en la plataforma murieron. El patrono no adiestro a su personal de mantenimiento en los procedimientos de inspeccion y mantenimiento recomendados por el ANSI/SIA A92.9-1993 parrafos 7.2,7.3, 7.4, 7.5, 7.6 y las del manual del manufacturero. Riesgo: Andamio falle, se rompa o caiga mientras los empleados lo estubiesen usando.sen
