Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard posed by operation of a powered industrial truck with a shop-made attachment that had not been secured to the forks: At the job site, on or about August 8, 2007, and at times prior thereto, thereto, the employer violated this standard, when a SkyTrak 6036, rough terrain forklift truck was fitted with a steel beam attachment used as a spreader bar in the process of setting down rebar mats and the attachment was not secured to the mast or forks, exposing employees to the hazards of being struck by the spreader bar and/or the load. Among other methods, one feasible and acceptable method of abatement would be to ensure that when attachments are used, extra care is taken in securing the load, as required by ASME B56.6-2002, Section 6.4.4.
