Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about July 16, 2007, and at times prior thereto, at the establishment located at 301 Lakeland Drive, Hot Springs, Arkansas, the right front post which supported the boat hoist structure was rotten, exposing employees to the hazards of being struck by the wench, motors or parts of the building should the building collapse. Among other methods, one feasible and acceptable abatement method to correct this hazard is to replace the rotten post.
