Text For Citation: 01 Item/Group: 002 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to struck-by/caught-in hazards while operating rough terrain fork-trucks that did not have an establish or scheduled inspection and maintenance program: a) On or about March 29, 2007, the employer did not provide a planned system for scheduled inspections, maintenance, adjustments, and repairs on their fork-trucks according to the manufacturer's specifications. No records of inspections or maintenance were kept. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to comply with ANSI B56.6-2005, section 7.2, by establishing and following planned scheduled maintenance and inspection of all rough terrain fork-trucks in conformance with the manufacturer's specifications. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
