North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to being struck by and run over by rail cars: a)Rail Yard - Employee crossing track 4f too close to rail cars was struck by and run over by the lead car on that track. Reference: PCS Phosphates policy number 53.01.00.02.018 dated April 2006 in section Crossing tracks, paragraph 4 "To avoid being struck if equipment moves unexpectedly, employee crossing tracks shall keep at least 25 feet away from the end of a standing train engine or cars".
