Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of crushing injuries due to inadequate training. a) Butterball, LLC & 150 Main Street, Longmont, CO 80501: On or before December 26, 2007, the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions associated with leaving the operator's position of the Ottawa Industrial Tow Tractor. The employer did not effectively instruct employees in procedures related to ensuring employees placed directional controls in neutral and applied the parking brake before leaving the operator's position. On 12/27/07, an employee was fatally crushed by the tow tractor he was operating. The operator exited the cab of the tow tractor with it in gear and the truck brake applied. The employee was found underneath the passenger side rear tires. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME/ANSI B56.9-1992, Safety Standard for Operator Controlled Industrial Tow Tractors, paragraph 4.15.1 states, "The user shall ensure that operators understand that safe operation is the operator's responsibility. The user shall also ensure that operators are knowledgeable of, and observe, the safety rules and practices in paras. 5.2, 5.3, and 5.4. Paragraph 4.15.2 states, "An effective operator's training program should center around the user's company policies, operating conditions, and tow tractors. The program should be presented completely to all new operators and not condensed for those claiming previous experience. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME/ANSI B56.9-1992, Safety Standard for Operator Controlled Industrial Tow Tractors, paragraph 5.2.8 Before leaving the operator's position: (a)bring tow tractor to a complete stop; (b)place directional controls in neutral; (c)apply the parking brake. In addition, when leaving the tow tractor unattended: (d)stop the engine or turn off the controls; (e)if the tow tractor must be left on an incline, block the wheels. Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees in that an employee was exposed hazards associated with not being properly maintained: (b)Butterball, LLC & 150 Main Street, Longmont, CO 80501: On or before December 26, 2007, the employer did not ensure employees were performing daily inspections of the Ottawa Industrial Tow Trucks. This condition exposed operators to unsafe operating conditions. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow ASME/ANSI B56.9-1992, Safety Standard for Operator Controlled Industrial Tow Tractors, paragraph 5.4.1 states, "At the beginning of each shift and before operating the tow tractor, check its condition, giving special attention to the following: (a)tires and inflation pressure of pneumatic tires (b)warning and safety devices (c)lights (d)battery (e)controller (f)brakes (g)steering mechanism (h)fuel system (i)couplers Abatement Note: Abatement certification and documentation is required for this item (See enclosed "Sample Abatement-Certification Letter").-Certification
