Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Being struck-by falling loads. a) Within the establishment, located at 5977 S. Third St. in Waco, Texas. On or about March 4, 2008, and times prior thereto, the employer did not ensure that the hook inspections were being performed on all the drilling rigs, exposing employees to being struck-by falling loads. Among other methods, one feasible and acceptable means to abate this hazard is to inspect all hooks in accordance with ANSI/ASME B30.10-1993 Hooks, Handbook of Rigging for Construction and Industrial Operations, and 29 CFR 1926.251 Rigging Equipment for Material Handling Standard" and to perform daily and monthly inspections of all rigging equipment which would include wire rope, fittings, clips, attachments, hardware, and rigs.
