Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the condition(s) listed below: Boom Drilling, LLC, Rig #10, Jones Energy - Willis D Price 16-H, Lipscomb County, Texas. For the period of time up to and including 09/06/06, the escape guywire was not flagged as per API RP 4G 14.5.f. API Recommended Practice 4G, Third Edition, June 2004, titled "Recommended Practice for Use and Procedures for Inspection, Maintenance, and Repair of Drilling and Well Servicing Structures", states in 14.5.f "The rig contractor shall be responsible for placing a visible marker on each guywire." Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure escape lines are flagged with visible material as per API RP 4G. "Pursuant to 29 CFR 1903.19(d), the employer must provide documentation that this violation has been abated within 10 calendar days after the abatement date."
