Title 40.1-51.1(a), Code of Virginia: Employer did not furnish employment, and a place of employment which were free of recognized hazards that were causing, or likely to cause death or serious physical harm to employees in that: Employee(s) was exposed to fall hazards while performing job related duties when employee(s) were permitted to work from a job made box lifted by the forks of a Terex TH844C forklift. The Terex TH844C forklift should not be used to elevate personnel, as it is not equipped for this purpose. One feasible, and acceptable abatement method among others to correct this hazard is to comply with the sign posted in the operators compartment, which reads: DANGER Death or Serious injury can result from handling personnel with this machine. Never equip machine with any form of personnel platform or allow personnel to ride on attachment.
