Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck or crushed by moving motorized vehicle(s): This hazard existed on or about July 18, 2006, and at times prior thereto at the scrap metal yard of the metals recovery facility,in that the employer did not ensure the competency of operators of yard trucks. Among other methods, feasible and acceptable abatement methods to correct this hazard include, but are not limited to: 1) Before allowing employees to operate motorized vehicles on premises, including yard trucks, ensure that they have successfully completed training consisting of a combination of formal instruction, practical training and evaluation of the operator's performance in the workplace. 2) Obtain and provide vehicle reference manuals for employees tasked with operating, inspecting, and maintaining respective vehicles. 3) Conform to state licensing requirements for driver training and assessment for vehicles that would ordinarily require a commercial driver's license for operations on a public roadway.
