North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious harm to employees: a)Facility - - The employer did not ensure that the bottom-running, one-ton Wright-Airway air-powered chain hoist was inspected as required. REFERENCE:ANSI/ASME B30.16 - Overhead Hoist (Underhung): Chapter 16-2 - Inspection, Testing, and Maintenance: Section 16-2.1.1 - Inspection Classification: b)1)Frequent Inspetion: Visual examinations by the operator or other designated person with records not reequired. a)Normal Service: monthly. b)Heavy Service: weekly to monthly. c)Severe Service: daily to weekly. 2)Period Inspection: Visual inspection by a designated person who makes records of external conditions to provide the basis fro a continuing evaluation: a)Normal Service: yearly. b)Heavy Service: semi-annually. c)Severe Service: quarterly. Section 16-2.1.2 - Frequent Inspections: c)2)Hoist upper limit device of electric- or air- powered hoists, without a load on the hook, [shall be inspected] at the beginning or each shift. NOTE:Among other methods, one feasible and acceptable method to correct this hazard is to initiate an inspection procedure for the Wright-Airway chain hoist that insures required inspections of the hoist covering the items listed in B30.16 - Chapter 2 are performed by competent personnel in compliance with the schedules contained in the Chapter.
