North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a) Facility, Shop Area - The Coffing 1 Ton Underhung Jib Crane had not been load tested as required. Reference:ANSI B30.16-2, Section 16-2.2 Testing, Paragraph 16-2.2.2 Load Tests (b)Electric Powered or Air Powered Hoists (1)Complete new hoists shall be dynamically load tested by the manufacturer as specified in paragraphs 16-2.2.1(b)(1) and (2) with a load test not less than 125of the rated load, except that if testing cannot be performed by the manufacturer, the user shall be notified and the load test shall be accomplished at another location or job site, by or under the direction of a designated person prior to the hoist being placed into service. (The user is testing the complete structure whether or not the hoist was tested by the manufacturer.) (c)The person conducting the load test shall prepare a written report of the load sustained during the test and the operations performed during the test. Reports must be place on file. NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to load test the underhung hoist as required and maintain a record of the load test.
