Text For Citation: 01 Item/Group: 002 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being crushed and/or struck-by the elevator: (a) Cycle Warehouse, Butler, PA 16001: On or about May 5, 2006 the freight elevator was operated without having a safety test conducted and being certified by the Pennsylvania Labor & Industry's Elevator Division. The elevator had been sealed by the State of Pennsylvania's Labor and Industry Elevator Division and the seal had been removed by the employer. In addition the freight elevator was missing a hoistway gate on the basement floor level. Among other methods, one feasible and acceptable means of abatement is to install a hoistway gate and to have the elevator undergo a safety test and then certified by the state of Pennsylvania's Elevator Division.
