Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught-between hazards: a)A-Du Well Auto Salvage & 5135 Emerson St. in Denver, CO: The employer did not ensure employees were kept from working under the elevated portion of rough terrain forklifts in that employees were permitted to work under elevated vehicles in order to remove parts. This condition exposed employees to caught-between hazards. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform the following: ASME B56.6-1992, American Society of Mechanical Engineers, Section 6.2.7 "Do not allow anyone to stand or pass under the elevated portion of any rough terrain forklift truck, whether empty or loaded".
