Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: being thrown from and struck by a Jarraff Mechanical Tree Cutter due to not being required to wear the machine's operator seat belts. (a)Southern Natural Gas Pipeline Mile Post 34.600, T2N, R9E, Section 26, Smith County, MS - On or about July 8, 2005, employees were exposed to fatal injury due to the failure to wear seat belts while operating the Jarraff Mechanical Tree Cutter, #SJ3, S/N WH053J0117. Among other methods, one feasible and acceptable abatement method to correct this hazard is to enforce the wearing of seat belts provided by the machine's manufacturer.
