Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being injured by the load: (a)B & D Industrial & Mining Services, Inc. - Lathe Department - On or about 03/02/05, the buttons on the pendant control box for the 1/2-ton hoist used to lift steel pins were not legibly marked to indicate the desired function. (b)B & D Industrial & Mining Services, Inc. - Steel Room - On or about 03/02/05, the buttons on the pendant control box for the 1-ton hoist used to lift steel flat bar were not marked to indicate the function. (c)B & D Industrial & Mining Services, Inc. - Fab Shop - On or about 03/02/05, the beam supporting the 2-ton chain hoist had not been load rated. Among other methods, one feasible and acceptable method to correct this hazard is to ensure that periodic inspections are performed in accordance with ANSI B30.16-2.1.3- 1993 Table 2, "Function labels on pendant control stations for legibility" and ensure that the rated load capacity is marked on the main structure or equivalent in accordance with the instruction given in ANSI B30.16-1993, Section 16.1.1.
